Terms & Conditions

Southern Bullion Exchange Limited · Last updated: February 2026

1. General

These Terms and Conditions ("Terms") apply to all transactions between Southern Bullion Exchange Limited (NZBN: company number pending) ("SBE", "we", "us", "our") and our customers ("you", "your"). By placing an order, requesting a quote, accessing our website, or otherwise transacting with SBE, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may update these Terms from time to time; the most current version will always be available on our website.

2. Products & Services

SBE deals in physical precious metals including, but not limited to, gold bars, gold coins, silver bars, silver coins, platinum, and palladium products. All products sold by SBE are investment-grade and sourced from LBMA-accredited refiners or recognised government mints where applicable. We also offer a buy-back service, educational resources, and market data. Product images on our website are representative; minor variations in appearance may occur between individual items.

3. Pricing & Quotations

All prices displayed on our website are indicative only and quoted in New Zealand Dollars (NZD). Indicative prices are based on the current international spot price plus applicable premiums and are subject to change without notice.

Live quotations are available upon request and are valid for the time period expressly stated at the time the quote is issued (typically 10–15 minutes). Once a quote expires, a new quote must be requested. SBE reserves the right to withdraw or amend any quote prior to your acceptance.

Prices include GST where applicable. Premiums vary by product type, size, availability, and market conditions. Premium schedules are available upon request.

4. Orders & Payment

Orders are confirmed only upon receipt of full payment. We accept the following payment methods:

Direct bank transfer (preferred)

Cash (for in-store transactions, subject to AML/CFT thresholds)

Stripe online payment (for selected products)

All orders are subject to product availability at the time payment is received. In the event of a stock shortfall, SBE will contact you to discuss alternatives or arrange a full refund. SBE reserves the right to cancel or modify orders if pricing errors occur due to technical faults, data feed errors, or human error.

5. Collection & Delivery

Products can be collected in person from our Bishopdale store during business hours, or shipped via insured, tracked courier within New Zealand.

In-store collection: Available once payment has cleared. You will need to present photo ID upon collection.

Courier delivery: Shipping costs are calculated based on the value and weight of the order. All shipments are fully insured during transit. Delivery timeframes are estimates only and SBE accepts no liability for courier delays.

Risk of loss or damage passes to the buyer upon: (a) collection from our premises, or (b) delivery to the address specified by the buyer. Title to goods passes upon receipt of full payment.

6. Buy-Back & Sell-to-Us

SBE offers a buy-back service for precious metals products, including items not originally purchased from us. Buy-back prices are based on the current international spot price less an applicable spread, which varies by product type and condition.

For buy-back transactions:

Products must be presented in person at our Bishopdale store or sent via insured post.

All items will be inspected, tested, and weighed before a final offer is made.

SBE reserves the right to decline any buy-back at its sole discretion.

Payment for buy-back transactions is made via bank transfer within 1–3 business days of acceptance.

AML/CFT customer due diligence requirements apply to all sell-to-us transactions.

7. Customer Due Diligence

In accordance with New Zealand's Anti-Money Laundering and Countering Financing of Terrorism Act 2009, SBE is a reporting entity and is required to verify the identity of all customers before conducting transactions. We may request identification documents, proof of address, and information regarding the source of funds. Transactions may be delayed or declined if satisfactory identification cannot be provided. Please refer to our separate AML/CFT Policy for full details.

8. Financial Advice Disclaimer

SBE does not provide personalised financial advice. All information provided on our website, in our educational materials, or by our staff is general in nature and should not be relied upon as a substitute for professional financial advice. The value of precious metals can go down as well as up. Past performance is not indicative of future results. We strongly recommend that you seek independent financial advice before making investment decisions.

9. Limitation of Liability

To the maximum extent permitted by law, SBE's total liability in connection with any transaction shall not exceed the purchase price of the products in question. SBE shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to lost profits, loss of data, or business interruption. Nothing in these Terms excludes or limits liability that cannot be lawfully excluded under the Consumer Guarantees Act 1993 or other applicable New Zealand legislation.

10. Intellectual Property

You may not reproduce, distribute, or create derivative works from our content without our express written permission.

11. Disputes & Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the New Zealand courts. Nothing in these Terms affects your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
